OSU Public Sales Terms and Conditions
- PROPERTY INSPECTION:
The OSUsed Store is a first come first serve sale. No preview is allowed. Oregon State
University makes no warranty, express or implied, as to quantity,
kind, year, character, quality, weight, size, or description of
any of the property offered for sale, or its fitness for any use
or purpose.
- CONDITION OF PROPERTY:
All property is offered for sale "AS
IS, WHERE IS" with no warranty or guarantee as to condition.
The customer is responsible for determining the condition of property
prior to purchasing.
- BID CONSIDERATIONS AND AWARD:
Oregon State University reserves the
right to reject any or all bids. The highest responsible bid on
each item is announced as the sale progresses. Successful bidders
are required to pay for their property as per these terms and conditions.
All sales are final.
- TITLE:
Oregon State University's interest
in the property passes to the successful bidder at the time of announcement
of award. At this time, risk of loss or damage will not release
the bidder from the obligation to buy the property. However, until
the property is paid for, Oregon State University retains possession,
as security toward the entire payment of the purchase price. Prior
to possession of the property by the purchaser, when legal title
of ownership passes from Oregon State University to the purchaser,
the University may, if it decides that it is necessary, practical,
or convenient, move any items. The successful bidder empowers Oregon
State University, as Oregon State University deems suitable, to
appoint an agent for him to move the property. Loading and transporting
items are the responsibility of the successful Bidder.
- METHOD OF PAYMENT:
- Cash -- including U.S. currency, cashier's check, certified
check, traveler's check or money order made payable to Oregon
State University.
- Personal Check or Visa/Mastercard
- If the check is in the amount of $1,000.00 or less it
must be accompanied by two pieces of acceptable identification,
one of which is photographic; or
- If the check is for more than $1,000.00 it must be accompanied
by a letter from a payor bank or financial institution on
which the check is drawn which guarantees payment of the
full amount of the check.
- Oregon State University reserves the right to reject any
or all personal checks.
- A purchase of any type in excess of $1,000.00 may be paid
for with a combination of personal check (in an amount not to
exceed $1,000.00), Cash, Visa or Mastercard.
- In lieu of full payment for titled vehicles and purchases
in excess of $1,000.00, the buyer may choose to leave a 10%
deposit the day of the sale to secure the purchase. Payment
in full must be received by OSU Business Services no more than
2 working days following the sale date. At this time the title
of the merchandise will be released.
- PARTICIPATION:
Bidders may be barred from participating
in Oregon State University public salesfor the following reasons:
- Failure to observe the terms and conditions as set forth by
OSU.
- Payment for purchases with a personal check which is dishonored
by a payor bank, depository bank, intermediary bank, collecting
bank, presenting bank, or remitting bank.
- Failure to pay for purchases.
OREGON STATE UNIVERSITY RESERVES THE RIGHT TO SELL ANY OR ALL OF THE SALE PROPERTY TO OSU DEPARTMENTS, STATE AND LOCAL GOVERNMENTS, AND
QUALIFIED NON-PROFIT ORGANIZATIONS WITH A 501C STATUS PRIOR TO THE SALE.
